Barrier Breakers® maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and Barrier Breakers®. If you do not agree to these terms, do not use this Site.
1. Use of Site
Users must be 18 years of age or older to participate in an Online Course hosted by Barrier Breakers® Users will need sufficient fluency in the language in which the Online Course is presented.
Barrier Breakers® provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”). Barrier Breakers® authorizes each User to view and download one copy of the Materials. Materials may be downloaded and a maximum of one copy of the Materials may be printed provided that Users make no modifications to the Materials and Barrier Breakers® retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials.
Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users may not copy, reproduce, duplicate, distribute, disseminate, publish, post (on social media, online, or elsewhere), display, perform, modify, create derivative works from, upload to, transmit, or in any way exploit any content from the Online Course and/or on the Website. Users may not sell or offer for sale any of the content, or allow third parties to access it, or use such content to construct any kind of database. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorized use of the Site.
2. User Warranty
As a User, you warrant that you are not an agent or employee of any other test preparation or admissions company and use the Site and Materials solely for the purpose of aiding you in the admissions process.
3. Trademark and Copyright
Barrier Breakers® and certain other brands, trademarks, and service marks are marks of Barrier Breakers® and its affiliates. The Materials on this Site are copyrighted, and any unauthorized use of any Materials on this Site may violate copyright, trademark, and other laws. All materials – including but not limited to text, photographs, video, audio, images, and any other content – appearing via the Online Course and/or on the Website are protected by copyrights and/or other proprietary rights belonging to Barrier Breakers® and/or other third parties.
4. Hyperlinks
Links to external websites are provided solely as a convenience to you. Barrier Breakers® has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. If you decide to access any of the external websites linked to this Site, you do so entirely at your own risk.
5. No Warranty
The Materials provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Barrier Breakers® further does not warrant the accuracy and completeness of the Materials at this Site. Barrier Breakers® may make changes to the Materials at this Site, or to the services and prices described in them, at any time without notice. The Materials at this Site may be out of date, and Barrier Breakers® makes no commitment to update the Materials at this Site.
6. No Guarantees
Users understand that using my services does not guarantee any application decision or outcome. Barrier Breakers® cannot and does not purport to guarantee admission into any particular school or tier of schools. Barrier Breakers® cannot and does not purport to guarantee any specific financial aid package, scholarship, or award. Designated fees are payable whether or not the user gains acceptance to the school of choice.
7. Non-Agent Status
Barrier Breakers® is an independent educational consulting company. Barrier Breakers® is not an agent and does not work for or on behalf of any particular institution. Fees are not accepted from institutions or programs for referral or placement of a client.
8. Code of Ethics
Users understand that Barrier Breakers® is not a consulting service that is going to write essays for Users. At no point will Users request that Barrier Breakers® write essays on their behalf or perform any other act of academic dishonesty.
By enlisting services, Users agree to refrain from any act of academic dishonesty including, but not limited to, plagiarizing or fraud. Any such act of academic dishonesty committed by the User is neither endorsed, nor encouraged, by Barrier Breakers®, and should any such academic dishonesty occur, Barrier Breakers® will terminate services effective immediately, without a refund.
9. User Responsibilities in the Admissions Process
Substantially completing all relevant written work in a timely manner
Preparing and studying for any admissions entrance exams
Scheduling of and making university visits
Sending official test scores to universities
Securing academic and personal recommendations
Completing and sending applications
Monitoring status of applications and advising universities of enrollment intentions
10. Course Content
The course description is intended to indicate only the general nature of the course and does not guarantee content. Barrier Breakers® reserves the right to amend the course and alter details at its discretion.
Barrier Breakers® is not responsible if Users fail to meet the Online Course requirements and Users should ensure that they allocate sufficient time to allow them to successfully complete the Online Course.
11. Technology and Security
Users agree to maintain the security of any username and password required for accessing the Online Course. Users will notify Barrier Breakers® promptly if they become aware of any unauthorized use of their username and/or password.
Barrier Breakers® makes no claim that the Online Course content is appropriate for any particular purpose or audience, or that it may be downloaded outside of the United States. Access to the Online Course may not be legal by certain persons or in certain countries. When accessing the Online Course and/or the Website, Users are responsible for compliance with the laws of their jurisdiction.
Barrier Breakers® reserves the right to remove Users from the Online Course and/or the Website if they do not respect these guidelines, Barrier Breakers® staff and/or fellow students.
The Online Course is facilitated through an online learning management system. It is the User’s responsibility to ensure that they have the proper hardware and software requirements, along with access to Wi-Fi, to be able to participate in the course. Users will need to ensure they have the proper technology at the time of registration as will be provided with the registration details
Barrier Breakers® is not responsible for any errors or failures in relation to Users’ ability to access the Online Course, the Website or any related materials, including where such errors or failures are caused by: (i) a loss of connection on Barrier Breakers® or the Users’ end; (ii) a breakdown or problems with the online software and/or (iii) a breakdown or problems with Users’ internet connection, computer or system.
10. No Refunds
There are no refunds for any services, used or unused. While Users may choose to take advantage of payment plan options, Users understand that obligation for payment is binding for the full term agreed upon.
11. Cancelation by Company
Barrier Breakers® reserves the right to cancel the Online Course by giving Users notice in writing (including by email) at any time before the course is due to start. Barrier Breakers® will refund all fees paid by Users and if possible, will endeavor to offer a transfer to another course as an alternative, subject to payment or refund of any difference in purchase price.
Barrier Breakers’ liability when it cancels an Online Course will be limited to a refund of the Fee or any other charges paid for the canceled Online Course. For partial cancellation of an Online Course, such refunds will be made on a proportionate basis. All dates are subject to change, however, notice of such change will be given and refunds will not be issued for any rescheduled class.
12. Limitation of Liability
In no event will Barrier Breakers®, its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever (including, without limitation, those resulting from lower admissions outcomes, interruption of services or inaccurate information) arising out of the use, inability to use, or the results of the use of this Site, any websites liked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.
13. Applicable Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland applicable to contracts executed and to be performed therein, without giving effect to the choice of law rules thereof. Any action to enforce any provision of this Agreement may be brought only in a court of the State of Maryland within Montgomery County. Accordingly, each party (a) agrees to submit to the jurisdiction of such courts and to accept service of process at its address for notices and in the manner provided in Section 13 for the giving of notices in any such action or proceeding brought in any such court and (b) irrevocably waives any objection to the laying of venue of any such proceeding brought in such a court and any claim that any such proceeding brought in such a court has been brought in an inconvenient or inappropriate forum. Users waive all rights to trial by jury.
14. Effective Date and Updates
The Terms are effective as of August 1, 2023 and are subject to change without notice by Barrier Breakers® at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
